Terms of Service

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

To access certain features, you may create an account using email or third-party authentication providers (e.g., Google OAuth). You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information and to promptly update it as necessary. We reserve the right to suspend or terminate any account that we reasonably believe contains false or misleading information.

The Service allows you to submit ratings, reviews, articles, artist submissions, and other content ("User Content"). By submitting User Content, you grant AiMCharts a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, display, and distribute such User Content in connection with operating and promoting the Service. You retain all ownership rights in your User Content.

You represent and warrant that you own or have the necessary rights and permissions to submit your User Content and that it does not infringe upon the intellectual property, privacy, or other rights of any third party.

AiMCharts is a music discovery and ranking platform. We do not host, store, or distribute any music files, audio recordings, or copyrighted musical works. The Service provides metadata, ratings, rankings, and links to third-party streaming platforms (including but not limited to Spotify). All music, audio, artwork, and associated intellectual property rights belong exclusively to their respective owners, labels, and licensors.

We make no claim of ownership over any music or artist content displayed on the platform. Album artwork, artist images, and streaming data are sourced from publicly available APIs and are displayed under fair use for informational and commentary purposes.

We respect the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, you may submit a notice in accordance with the Digital Millennium Copyright Act (DMCA) by contacting us at contact@aimcharts.com with the following: a description of the copyrighted work, the URL of the allegedly infringing material, your contact information, a good-faith statement, a statement under penalty of perjury confirming accuracy, and your signature.

Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing content.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Rankings, scores, ratings, and all data displayed on the Service are generated algorithmically from community input and third-party streaming data. We make no guarantees regarding the accuracy, completeness, reliability, or timeliness of any information on the Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AIMCHARTS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST TWELVE MONTHS.

You agree to indemnify, defend, and hold harmless AiMCharts and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, either party may pursue resolution through the courts of competent jurisdiction. You agree that any legal action shall be brought exclusively in the courts located in Israel, and you consent to the personal jurisdiction of such courts.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including but not limited to breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions that by their nature should survive termination shall survive.

We may revise these Terms from time to time. The most current version will always be posted on this page with an updated effective date. By continuing to use the Service after revisions become effective, you agree to be bound by the revised Terms.
